What Is the Difference Between a Lease Agreement and an Amendment?

A lease agreement is the original contract that establishes the rental relationship between the tenant and the landlord. It includes the core terms, such as:

  • rent amount,
  • apartment details,
  • duration of the lease,
  • deposit,
  • utilities,
  • and the rights and obligations of both parties.

An amendment (“dodatek”) is a separate legal document that changes or updates part of the existing agreement without replacing the whole contract. 

 

What Is Usually Solved Through an Amendment?

In Czech rental practice, amendments are commonly used for changes such as:

  • extending a fixed-term lease,
  • increasing rent,
  • changing utility advance payments,
  • allowing pets,
  • updating the number of tenants,
  • adjusting payment conditions,
  • or changing specific apartment rules. 

Instead of creating a completely new contract every time something changes, landlords and tenants usually handle smaller updates through amendments.

 

Important: An Amendment Is Legally Binding

An amendment is not “just paperwork” – once signed, it becomes legally binding in the same way as the original lease agreement. Read it carefully, check what exactly is changing, and never assume it’s only a formality. Even a short amendment can significantly affect your rights or monthly costs.

 

Always Check Dates and Signatures

Before signing anything, make sure:

  • the amendment clearly references the original lease agreement,
  • dates are correct,
  • the effective date is specified,
  • and both parties have signed the document.

Verbal Agreements Are Risky

In Czechia, rental agreements and their modifications should be in written form. If you agree only verbally, that may not help much later if a dispute arises.
